By creating an account or using MemoryWeaver, you acknowledge reading and agreeing to these Terms and the Privacy Policy. Non-agreement means you cannot use the services.

2. Eligibility

Users must be at least 17 years old with legal capacity to enter into these Terms.

3. Account Registration

Users must:

• Provide accurate information
• Maintain credential security
• Notify immediately of unauthorized access
• Accept responsibility for account activities

4. Description of Services

MemoryWeaver offers AI-powered tools for recording, transcribing, and generating written stories from voice recordings, including:

• Voice recording and audio transcription
• AI-generated story creation from recordings
• Story storage and management
• Family collaboration features
• Optional premium features

5. User Content and Ownership

Users retain ownership of all content created. Bite Size Elephant receives a limited, non-exclusive license to:

• Process audio recordings into transcriptions and stories
• Store content on secure servers
• Display content to family members you invite
• Use AI services to improve and generate stories

The license terminates upon content deletion or account closure.

Family Collaboration

When you use family collaboration features, you control who can access your stories. Each contributor owns their own content while original creators maintain control. Access is revocable through privacy settings.

6. Acceptable Use

Prohibited uses include:

• Uploading illegal content
• Sharing hate speech or harassment
• Impersonation of others
• Unauthorized system access or hacking attempts
• Commercial use without permission
• Uploading malware or malicious code

7. Subscription and Payment Terms

Free Tier

Unlimited personal stories at no cost (with pricing limitations).

Paid Subscriptions

Include:

• Family collaboration features
• Enhanced AI capabilities
• Professional exports
• Advanced privacy controls

Billing

• Monthly charges are non-refundable except where required by law
• Cancellation effective at billing period end
• 30-day notice required for pricing modifications

Payment Processing

Payments are processed by secured third-party processors. We do not store complete card information.

8. AI-Generated Content

Users acknowledge:

• AI content derives from their audio input
• They should review all generated content for accuracy
• AI interpretation may not perfectly capture their intent
• They bear responsibility for the final content they share

9. Disclaimers

Services are provided "as is" with no warranties regarding:

• Error-free operation
• Complete accuracy of transcriptions or AI-generated content
• Permanent preservation of content
• Fitness for specific purposes

10. Limitation of Liability

The company is not liable for:

• Indirect or incidental damages
• Data loss or corruption
• Service interruptions
• Damages exceeding amounts paid to us in the previous 12 months

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia and the United States.

Informal Resolution

Before pursuing litigation, you must contact us at privacy@bitesizeelephant.com to attempt to resolve the dispute informally.

Arbitration

Disputes will be resolved through binding arbitration in Arlington, Virginia, except for matters eligible for small claims court.

Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class action lawsuits.
